Nomination for Antitrust Writing Awards

5 May 2021

IFN researcher Henrik Horn's paper  ”International Jurisdiction over Standard-Essential Patents” is nominated for the Antitrust Writing Awards 2021.  The Award is issued by Concurrence and George Washington University. The paper is nominated within the category Intellectual Property and is one of ten nominated papers.

Standard essential patents are patents required to meet an industry standard. One example is the 4G standard for mobile communications used for mobile phones by consumers and manufacturers in a large number of countries. Holders of standard essential patents are often obliged to license these on "reasonable" terms under agreements with standard-developing organizations. Henrik Horn's paper highlights the economic consequences of the jurisdiction over the monitoring of these commitments being divided between national competition authorities in accordance with the basic principles of jurisdiction in international law — the principles of territoriality and nationality.
